My friend was in the process of a divorce & married again 1 month before her divorce was final. Why you ask? because the 1st husband she hasn't seen in 5 yrs & the new husband was being deployed in a month to Iraq & deployment is from 12 to 18 months. He wanted to make sure that she & her children were cared for by the military should he die in combat.

NO.. it's call polygimy (sp). The second marriage is not valid and she will not get anything if he should die in combat. They will check the court records and find that she was not divorced yet, therefore the second marriage is illegal and void. This is not something new!

there was still a pending marriage order. look, the only way the second marriage would be contested is if the second husband wanted a divorce and didn't want to pay spousal support therefore proving the marriage was no longer valid.

so....when he gets back....go get married again.

That would still be considered married to 2 at the same time. Terrible perdiciment but in a court of law I fear she would lose, if for some reason it was contested.

well, that's a bummer... but no, not legal until the waiting period after the divorce hearing has passed...
