I am filing a small claims case in regards to an ebay fraud. I paid $789.00 for a television i never received in return, as promised by the ebay seller. Now I have to take him to smalls claims court out of state. They county clerk said that there is a pre-trial hearing scheduled 45 days after filing. Now if we don't come to an agreement and he still refuses to give me the money owe to me, that means i would have to fly back to Florida again. Which means more travel costs. The cost of travel will end up being more than i am suing for. My question is can you do pre-trial cases over the phone??? I know small claims probably will not reimburse for travel.right? even if it is fraud?? What should I do?? Please help! I don't want this loser to get away with this. Its not fair.

In many cases, you can arrange with the court to appear by phone. Call the Clerk of the Court to make that arrangement.

You are the buyer. File against the SOB in your state. The Judgement can then be filed in the state of Florida against the SOB that ripped you off. The constables will then collect on the judgement.

You can consult with a lawyer (in your state), tell him your situation and tell him that you will give him $200.00 to consult on the case.
