I am a Pakistani and my spouse is a US Citizen. She applied for a I-130 IR petition for some time back. It has recently been approved. I am applying to MBA programs in the US. Can I apply for US universities as an international student while in process of applying for a US immigrant visa or should i apply as a Permanent resident after reaching the United States? Is there any law regarding this? Am I allowed to apply to universities while in process of Applying for Immigration? What should I write as my status on the application

There is no law that prohibits you from applying to universities, however it may be better if you just apply as a permanent resident once you reach the US since you will be eligible for financial aid consideration. If you apply as an international student, that would mean that you would need to apply for an F-1 visa and that is not your case. Contact the international students counselor at the university of your choice and ask her/him what would be the best route for you. They will be in a better position to point you in the right direction. Good luck!

have you been admitted by the school?If not don't apply to any school yet or else you'll be forced to pay international student's tuition till you leave the school.Let your fiance work on any requirement possible for you to be an in-district student or you'll pay out-of- state tuition which is approximate to the international students fee.You can also pay international student's fee on admission until you meet the criteria of in-district tution (6mnths-1yr).When you apply to a school and start schooling,it becomes a contract until you meet the criteria.Don't rush,when you get here,they you sort things out.you might be lucky since you'll be a citizen by then.
