Do I have the right to Sue my employer if I do not like the Workers Compensation decission, rather than appeal? I live in New York State.

It will be a hard case to win, so what i would do is just appeal the comp decission and you will be assigned a new judge and see where it goes from there. Then try suing your employer, but it is gonna be a hard case to try with a comp decission already in place.

You can sue anyone over anything in America. It doesn't mean it's right to or that you will win or that your case has any merit, but there's a lawyer under every rock and I'm sure more than one of them would jump on the chance to help you sue just because you didn't *like* something.
