Can she remove my name from my son without my consent?

She can change his first name, however, if you signed the birth certificate as his father, she would need you to sign off on this document. She cannot change his last name, have another man adopt him or anything of the sort. Not without you signing off on the paperwork. Unless you have given up all of your rights as his father. And again, this would have to be done in a court with your signature. I think she is just trying to make you angry and upset. Good luck and God bless

She can't remove your name. The judge will not allow something like this b/c it's taking away from your manhood. Even when she tries. Unless you are not the father, the judge will side with you. So don't worry about it. It's hard to change anyway. If she says you passed away, she would have to present a death certificate. How does she intend to collect child support? She won't if she removes your name.

You should take her to court for visitation rights and file for child support. Pay her child support through the courts so you can get your son the way you legally should. As for the name, it WON'T get changed.

I don't know that she can do this even with your consent. That is his Birth surname and I have never heard of that being changed before! Check with a lawyer.

What did you do to her? Geez! Drastic, indeed. You need to find out the laws in the state where she is now residing.
