Va. "employment at will" laws are not for the working people, and we need to do something about them. This law is for the Employer, which means they can terminate you at any time with little or NO reason. If you are employeed in any job that is not union, you fall under this law. We need to get this reversed or changed to benefit the employee, not the employer.

Good luck. "At will" employment is the law in (just about) every state. And it benefits the employee, too, to some respect -- if you're an at-will employee, you can quit at any time.

There are some restrictions already on the employment at will doctrine. (1) An employer cannot fire you because you're a member of a protected class (race, religion, gender, etc.) (2) They can't fire you if you blow the whistle on your employer by reporting a violation of the law to authorities (sometimes). (3) If you have a contract, of course, they cannot breach the contract. (4) They must comply with other wage, hour, and other employee safety laws. And, almost always, you can quit for any reason and they can't force you to work or sue you for breach of contract. (You may be giving up some extended benefits like unused paid time off if you do, but most of the time, they can't haul you into court.)

There's no (rational) judge in the country thatwill overturn the employment at will doctrine. If you want to change it, contact your legislator to enact more protective employment laws; get a unionized job, or unionize your shop; or simply find an employer that's willing to enter an employment contract with you.

Start with your state Senator and Representative. They write bills and move them through the legislature.

If you can show practical reasons as to why the law should change, they may listen. If you don't like the law, or don't agree with the law, it won't get changed.

Most laws have pros and cons. I am in favor of allowing employers to hire and fire as the employer's needs change.
