In case of common law, marriages.
Most answers are correct but I look at it from a different angle(legal).
It will be a scenario in which people leaving to gather sharing the assets together like husband and wife, and even have children of each other, and no one else, then they do end up in family court to work out separation.
In my thinking they had common law marriage and most state and lots of countries recognises this, so they have to take a divorce, even though, they were never married before.

The chapter of the Talmud "GITTIN" which deals with divorce comes before the chapter that speaks about marriage

Neeti, diavorse came after marriage because if you dont get married to someone then how and fom whom you get diavorse.
