The act of the prankster was unlawful because it resulted to psychological distrubance of the family offended. Although the intention was not to hurt the family, the act done was disturbing for the offended family. Under the Penal Law, a mistake in the intention is still punishable because of the fright produced on the offended party.

i think that it is unfair that he is not in jail or something! come on, he is 14 and so what? that did not give him the right to do the actions that he did and in my opinion he should pay for his actions...you know that there is a saying that for every action there are consequences, what happened to that in today's society? it does not matter if it was a prank or the real thing and if a 14 or 21 year old were to do it, justice would need to be served. the police let him go as though nothing bad has happened and it is people such as those officers that let stupid people do idiotic things until danger occurs and then they blame it on somepne else! the kid should of had some punishment done on his behalf by the authorities but he will not know since he is a minor! and arent a lot of monors tried for different things in today's society?then what makes this case special? the law, the officers and how they carried out the law makes all the difference! the police is to blame for letting the kid go with out any punishment and they will the ones to blame if something happens to that poor woman not as a joke but as the actual thing! the law appearantly does not apply to everyone and this kid is a son of a ***** to get away with what he did, nevertheless his behavior is destructal to the mother and her children! appearantly this kid cannot apologize or is a snob and thinks he does not need to! all i can say is that what he did will come and bite him in the end since what comes around goes around-karma!

I think a punishment should be given to the kid's parents for allowing their son to go out dressed like that and carry a gun real looking enough to scare someone. He's lucky that is all that happened to him; he could have been shot by the police or a resident he tried to "hold up". The kid also deserves to be punished but to me the blame lies with his parents who have obviously not taught him better and are probably home laughing it off as a little "prank" their son played. If they are responsible parents, they should have already punished him and explained to him all the reasons why what he did was so wrong and made him write a letter of apology to that family....and any others he "held up" that night.

He is lucky he didn't get shot. He probably would have if he came to my house and tried that. Yes, he should be sent to Juvenile system. That is so wrong and he should be counceled and warned about consequences of doing this ever again. Wow, shocking that he got away with it with no punishment. She should go seek counceling and press charges on the family. It would not surprise me if the family isn't sleeping well at night now. Those poor kids. Halloween will never be the same for them.

You should go to his house one night and bang on his door... once he opens it you should snatch him up and give give him a good a$$ whooping.. This kid will probably be robbing people for real once he realizes that it takes police 45 minutes to respond and if he gets caught he'll just make some excuse to get out of it......
Show him that your not going to take any crap from him and that if the police will not do anything you will. Don't take it easy on him, he is a piece of crap!!!

The whole community must come together and condemn the henous act. The boy's parents must also be told about it and I am sure the dumb kid will get punished somehow. Such things can't go unpunished, and he must apoligize. No need for police involvement.

it part of the society. as long as the television, movies, and video games are gun crazy, you are going to see kids and adults doing the same monkey see monkey do. its a sign of a bigger problem.

the 14 yr old is acting out with what he sees elsewhere and there are less positive influences that would prevent him from acting this way.

obviously in dealing with issues and it would be proper to apologize. unfortunately these things will become more and more common not less so, as long as violence sells in the media.
