The last time my ex came to visit our 3 1/2-year-old son, he showed up with a girlfriend (I think) who he didn't introduce me to, didn't give me an itinerary, and withheld the girlfriend's cell phone number, the only phone number they had for the day. I let him take my son, not fully realizing the situation beforehand, but now I would like to prevent him taking my son without giving me a phone number. Anyone know legal requirements for visitation in California?

Note: I have 100% physical custody and 50% legal, with visitation "upon agreement of the parties." Note: my ex defaulted on the divorce - didn't respond at all. He left me and the baby when the baby was 6 weeks old. He pays a little bit of child support, but much less than he owes.

Since you are the full legal guardian of your son you have every right to have a number to reach them in case of emergencys as well as an intenary on where they will be. If this information isn't forth comming you can legally inform your ex that until he has a working and reliable number that you can call he Cannot take your son anywhere. You might also want to contact your lawyer who can give you some really good advice as well. Your son's father (depending on the state that the order was granted in) may even loose visitation rights for failure to pay child support. There is alot of new laws that are governing child support and rights of non custodial and custodial parents, hence the lawyer can let you know what new laws have taken affect in the state you are residing in. Ok first if it is not the law, I would fight every step of the way to ensure he never , ever took my child without a complete itinery, at least one phone number that I had in advance to verify. It takes less than 4 hours for this man to take your child and be across the border, I know that is not a risk you would want to take law or not law. I agree with LrnHDwy 100%, he is shown nothing that makes him responsible or even a good influence on your child..The number kidnapping of children is done my a parent as I am sure you know,,don't ever take the chance with your precious child..Does he even deserve visitation? I believe so strongly about this I could go on and on but you get mine and the other idea..Stand your ground, Honey, he sounds like a piece of work..

He does'nt sound very responsible or trustworthy.....What would you do if he did not bring the baby back????...I would not let him and some stranger take my child and me have NO way to get in touch and/or know where he is....He gave up those rights by leaving and defaulting on the divorce....What a winner....It is up to you to protect your child....He obviously didnt care enough before....Dont make excuses for him..

You have every right to have a phone number, in case you need to contact them.

You also have a right to know where they are going?....I'm not sure of the "whole itinerary" but if they have plans for a big day out etc....you should defiantly know.

I believe if you have the majority of the custody he has to give you a number...Itinerary, not to sure...but phone number you should definitely have...
