My daughters boyfriend was in high school and this girl keep asking for his prescription medicine which was his for his ADHD. She asked him numerous times and finally he gave into her. She took the pills which was a total of 4. Shes also friends with my daugther. She came over that night and I gave her a ride to the football game, my husband picked up the girls. Well anyways she claimed to have a reaction to the pills which was concerta. The next time in school, she told the prinipal that "Joe" gave her these pills. Needless to say he was suspended for 10 days, taken to juvenile detention, had to go to court. Now he is waiting to go to court again. I guess they are charging him with a felony, maybe not allowed back in high school. This is his 1st offense, never been in trouble before. He received no money for the pills. The girl that took the pills, had asked for these pills for weeks, she lied to the school and said she thought they were asprin, she knew that they were. Any advice?

If he doesn't already have a competent attorney, you need to hire one immediately.

These types of cases can be especially complicated, as there is more at stake than you may realize. For instance, a conviction on a drug charge may mean reduce or little eligibility for federal student aid in college, (if he decides to go that route). Although it IS against the law to give anyone a drug that is not prescribed for him, there is always grounds to review this with the prosecuting authority.

I urge you to contact a skilled criminal defense attorney in your area. Be prepared to pay a sizeable retainer. For a referral to a criminal defense attorney, contact your local or state bar association.

There's really nothing you can do. It violates a Federal Law to give someone your prescription, and it doesn't matter if it is the first time or not. Just be glad that he is a minor, and hopefully will be charged as such.

Never trust anyone who is asking you to do something that is illegal. The kid is toast unless he can find a creditable witness to testify that she is lying.
