You have 2 people that just had a baby and they are not married. The grandmother does not think the baby belongs to her son. Can she get a court ordered DNA test? Can the mother refuse to take the test?

It really should be between the mother and father. If you don't have one of their support, than no, you won't be able to.

If you get your son to contest paternity, the court will order a DNA test and the mother of the child cannot refuse to have the child tested (if she does she will lose the case).

You are a third party to the situation. You cannot contest paternity because you are not the father, even though he is your son. You have to work through your son if you want to go through the court system.

It's probably easier to just do the DNA test yourself instead of through the court. Google "DNA paternity test" -- several companies selling $99 kits will come up in the search. Buy a kit and next time your grandchild comes for a visit, do a painless mouth swab with the kit. Do the same for your son and then send it in and you will get the answer. You don't need the court to get involved.

Yes she can get a court order and no the mom can not refuse and if she did well then that is telling everyone she is hiding something.

When it comes to child support it is in her best interest to get this test done because if she gets this guy to pay child support and then a few years from now he finds out the child is not actually his the mother will have to pay every cent back to the guy that he gave to her in child support, they do keep trak of how much you pay so they will know the exact amount he paid her.

If the mother refuses the test, then the father should be able to contest paying child support until she agrees to it. If not he will be paying her child support for several months/years until she agrees to test, then she will have to pay him back???I'm not sure, but if nothing is done now, eventually the courts will deem him the father if takes the role from the beginnig and not contest anything-any child support paid will most likely not be returned if the father does not contest from the very beginning.

Why would the grandmother care? In my opinion, it's between the mother and the father to work things out between them. Grandparents should stay out of it!
