You should first try to work with your professor to find an alternative to make up the points the exam was worth. Her reasoning for not giving you the same exam that everyone else had, since your classmates may have told you what was on it.
If you can't come up with an alternative for you, then you should talk to the chair of the department next, and if he/she can't resolve it, then to the dean of the school.
You should document all these as well, in case you want to challenge your grade at the end of the semester. Most colleges have a process for doing that where you appeal to a committee, but you need to have good evidence for your case.
Suing in a court of law probably won't get you anywhere.

First of all, if you sent an email in all caps, she would be well within her rights to say no - that's just rude, as is threatening to sue. You can't sue her, but you can try taking it up with the university. Look over the syllabus she gave out and look up the college's policies. Most teachers don't have to let you make up the exam if they don't want to - it's up to them; you're probably out of luck. Personally, based on this question, she's probably just sick of you. Try toning it down a notch if you want her to let you take the exam.

You can sue anyone... winning is another matter. I suggest going over her head to the dean or someone even higher in the administration. Let them know how you feel... but do not disclose that you are considering legal action. If they don't help resolve the matter, then you can sue on your own or hire an attorney.

Well was it an unforseen illness? was it a pop quiz? did you know about the test in advance and you still went to the doctor? that is probably why she wont let you retake it. if it was on the syllibus and still missed it because you planned a doctors visit she has every right to not let you take the test. ask her to take it at the end of the semester

okay well if you had a doctors note like you said and she didnt take it then she is wrong. since you have a note then you should be able to make up the exam. thats your grade and your right to make sure you get a good grade. maybe you should start small. take it to someone else at the school like the principle. if she still doesnt budge then maybe you should do whatever YOU think is right.
