O.K., here's how it works...
If you are surfing along doing your thing On-Line, WHO CARES?
No, you are not being monitored.
The government DOES monitor certain websites.
Sites that deal in terrorism, sites that disclose nuclear technology, military sites, sites that have illegal activity, like Child Pornography sites.
If you visit a site that is being monitored, then law enforcement can get a warrant, like a search warrant, to monitor you activity real-time. Very easy to do.
As to the Internet Service Provider (ISP) issue...
You ISP tracks every website you visit and every file you download. They don't keep a copy of each file, just the file name and the site from which it was downloaded. This is stored in a log file. And they back this information up at least every day.
Ordinarily, no one looks at this log.
(Just like your phone company keeps a record of every telephone number you make a call to or receive a call from)
(They don't normally record your conversation, just a record of the call.)
So if law enforcement gets a warrant and goes to your ISP, they can find out every web site you have visited and every file you have downloaded for the past (I think 3 years).

According to them they do.
THIS is a "hotly" debated matter regarding privacy.
As far as I am concerned they can watch anything I do, for the most part it would be VERY BORING.
Especially when I access THEIR databases, for which I DO have the necessary clearences, and access codes!! (I used to "contract" to the "government.")

The goverment has no right to monitor your internet. Your isp doesnt keep track of you either. However everywebsite you visit logs your ip address which can be used to track you back. so if you do anything illegal online it can be traced right back to your house.
