I filed a small calims case against the management company of an apartment I lived in. They moved their office without a forwarding address. I dismissed that case without predious and filed against the apartments. I went to court today and the judge is allowing them time to file a motion to dismiss the case due to the first case being dismissed without predious. Can I get the first case overturned?

No, you can't get a case overturned if you dismissed it voluntarily. And you should not think that simply because the judge is allowing a motion to be filed that he or she necessarily will grant the motion.

However, the best advice for you is undoubtedly to consult an attorney in your jurisdiction. A company will be represented by lawyers, and the court will not grant you any extra consideration simply because you're not trained.

The answer to your question depends on the laws of your state. You didn't specify where the case was pending so the only answers you receive hear will be based on speculation. Update your question to state where the cases were filed and you might be an answer from an attorney in your area.
