We live in Virginia. The restaurant now has a posting in the window from the rental management company? Should we call them, go to small claims court, report this to a government agency or even the IRS? Any ideas that would lead to him getting paid would be appreciated.

Put in your request with the bankruptcy court, but you'll be faaaarrrrr down the list of creditors that get paid.

Chances are that he filed bankruptcy and closed the business.

You can take him to court however as in all bankruptcy cases he probably has sooooo many companies and creditors taking money from him that by the time the top creditors are done, 50% of the rest are left with nothing, as there is nothing left of the business to take.

Wages are on the bottom of that list.

Im sorry to say but its a lost cause.

If it was an unexpected closure...they either intend on filing banckruptcy or already have.
If thats the case you would have to contact the mangement company to find out who the lawyer is.
Then you would have to file a claim with the court.
Just keep in mind...Banks and large creditors are 1st...the employees are last to be paid...always have and always will. But the owner and attorney could ask for special needs to pay employees prior to any court dates.....it depends on the lawyer and if there is any money.

The restaurant business is very risky. I doubt you'll ever get your money back so I suggest you just move on. Getting any money could take you a while if that's even a possibility. This happens in the restaurant business all the time. My sister and her husband had a restaurant and they have a lot of stories.

Unfortunately he's probably out of luck. He should go to the local unemployment office and seek their help on it but when this happened to me they told me that if the business had no money left that I was going to most likely not get paid and I never did. Still it's worth trying but most the time when a business closes like this they owe everyone around money. Good luck though.

s hit happens. move on. ive been screwed like that countless times from restaurants. They're bankrupt. Sorry. Your best bet is the better business bureaue, but you're not gonna get any money if the place doesnt have any money. Better to work at big corporate restaurants and stores. Good luck.

I'd hunt the boss down...oh, he would know how I felt. You just don't do people like that. Even if I couldn't get my hard earned money, I'd get an explaination. Then, I'd take him to court and check with the unemployment office.

i am sorry to hear this. he was probably very poor at handling money and maybe has none...i would suggest working for a much larger chain store to prevent this from ever happening. small claims may work but it is a long shot

you can ask a lawyer what the law in virgina is for payingworkers when a bussiness closes.maybe your sons boss is behind his rent building pay ments.i hope this information was helpful

small claims court would be best,then check with IRS& Soc.Sec. to see if he has been paying into the funds.. sounds like a shyster to me.
