I wrote a post dated check that was to be cashed on the 6th of this month, They not only cashed the check 4 days prior- when i went in to speak to them they told me i would have to pay the late fee of $50, + the bounced check fee- for both parties- totaling $95.00.

So now they tell me that they cant accept any checks from me- and the rent is due at 12 by 12pm on the 1st, and no post dating of checks will be accepted.

So they want me to pay and addntl. 1200 bucks a year- is that at all legal???

People do this, and banks also help them to do it, best not to wriet post dated cheques really, there is nothing you can really do about it, you dont explain how they want an addiitonal 1200 dollars P.A, but try putting away at least two months rent on standby ready for each monthly pay date and see if that works more to your advantage or even better pay one month in advance if possible, that way you dont get caught like this. Have a breather some times.

We own a business, and we are located in wi, so not sure if its a state law, but have had checks bounce against us, and have to file for payment through the D.A.'s office, they will go after the money and we asked about the $30.00 return check fee which we have posted, was told by the D.A.'s office they cannot collect that and we bite it on the bank fees, because its NOT legal to charge a returned check fee. But most people don't know that, so they end up paying it, you may want to check with your local D.A.'s office to see what is legal and what isn't.

Yup, it's listed in the terms and conditions you agreed to when you opened your account.

Try asking for a one time courtsey credit. And be nice when you do it - no blame on the bank or being rude. They can credit you. You just need to make them WANT to ....
