i've been told by my boss if i do not go to the xmas party, which is out of works hours, i will not receive my xmas bonus. i have had a bonus every xmas since i started 3 years ago. other people from work are going and will receive their bonus but others are not going and have been told they will not. is there any legislation online i can confront the boss with?

I am sorry to say this but the answer is yes he can do that but not for the reason of blackmail. A bonus is not classified as a right and therefore he doesnt have to give you a bonus BUT if the reason that he doesnt give it to you is just because you did not go to the christmas party then this is classified as blackmail. If he does not give you a bonus you need to get him to put it to you in writing as to why you never got the bonus. Once you have that you can go to the local job centre and ask to speak to the industrial tribunial people. They will sort it for you and it will not cost you anything. You really need to approach him first and just state that the reason why you do not want to go to the party is because it is your time and therefore not compulsory but if he would like to stage the party in work time then you would be more than happy to go along. Try talking with him first then if that fails go the industrial tribunial route

But considering you likely have nothing in an employment contract that states you must receive a bonus, the bonus is discretionary.

You don't have to go to the party to keep your job, but they don't have to give you a bonus either.

However, there may be some laws regarding religion that would be violated for a strict "come to a 'Christmas' party or forfeit your bonus" issue, if that is how it's going down. But is it a Holiday party? Minute difference, but significant.

A bonus is compensation, recognition of a job well done in support of the company's goals. It is not contingent upon attendance at a Christmas Party.

Refusal to pay earned compensation is a violation of the Fair Labor Standards Act, which is administered by the Wage and Hour Division of the Department of Labor. Contact them for clarification and (if necessary) to file a complaint.

Awww Sarah your not on your own a lot human beings have made stupid mistakes fairly at Christmas activities even as drink is in contact. at first you want to make it sparkling to the guy it is going no more effective and that is not likely to proceed i recommend you both get a verify up on the Dr's to envision for stds and also get the morning after pill . i in my opinion am not particular about telling your husband that has were given to be your decision ..walk into artwork such as your head held extreme chance isn't any one said you besides , desire each and every thing works out for you :) good luck x

He cant force you to do something you dont want to do. You are entitled to your bonus just as much as everyone else, you have worked all year. There are a lot of people who dont like going out with their colleagues for various reasons.You dont have to do anything for work in your own time.I dont know whether he is discriminating you, or being oppressive. Our boss stopped giving Christmas bonuses as of last year. So I am not going to the stupid Christmas part so he can act like a big business tyrant for a few pieces of free pizza and a stupid white elephant gift exchange. What a waste of my time!

It seems very harsh.

From an employment law perspective though, unless the bonus payment is in your contract (which I doubt), he is under no contractual obligation ot pay it/not pay it so it appears you'll either have to go or buy all your prezzies from Poundstretcher this year.

a bonus is just that go to the party have fun get your bonus. there is no laws saying you have to get a bonus at all. i have worked for some companys and never even got anything from them. cause they are too cheap to give anything. just be glad you get anything at all

I know you can get the sack at a xmas due because it classed as work for some reason.

How does that make sense? What if you had a good excuse for not going, like you were going out of town? Are you sure your boss isn't pulling your leg?
