Because Mikel signed the intial transfer papers stating that he wanted to sign for Man United. He did the press for the inital transfer.
He couldn't make the transfer at the time because the club he was with weren't in a transfer window and he had to wait for the transfer.
In the meantime, Chelsea came in and offered him much more money and the lure of doing much less work. He than came up with some cock and bull story about United kidnapping him and threatening his family until he signed. he went on strike and wouldn't play for his club or country until he got his way. Chelsea and Man United went to FIFA to get it sorted. FIFA couldn't prove any wrong doing on Chelsea's or Man United's part but because United had the transfer agreement with all the necessary signatures from both clubs and all agents involved in the transfer and Chelsea had squat. So in an attempt to be fair and smooth the situation over Chelsea was to pay Oslo the transfer fee for Mikel and to pay United. However, no money was ever paid out by United for Mikel as money could not change hands outside the transfer period. So United lost their player but made a profit out of the deal.

man u had paid the signing fee for obi and loaned him out to lyn oslo to mature not realising that a talent can not be hidden then came chelsea who kept close eye on the progress of the lad soon after his outstanding perfomance at the last under 20 world cup at the netherlands where he was voted as the 2nd mvp behind messi he soon caught the interest of chelsea who manipulated him into signing another contract so then man u took the case to court and fifa gave the verdict that man u will be given the signing fee for the player and lyn oslo also but i still stand to be corrected he made the greatest mistake of his career going to chelsea and he is already reaping the dividend.

Whether you play for a club or not is irrelevant. This guy professed his wish to play for United and duly signed registration forms. Then he was lured by Abramovitch's millions and decided he wanted to sign for Chelsea. United had lost a potentially gifted player so charged, quite rightfully, a fee to transfer Mikel's registration.
