This is a property settlement! All the children have pasted and there is 5 living grandchildren from 2 of the pasted children. Would each be intitled to 20% or would it be divided 50-50?

The property is in Missouri and there is no will!

This depends on the deceased's will (that is, the grandparent's will). If the will says that the estate is to be divided "per stirpes", then each branch of the family gets an equal share. But this is only one of several ways that the will could be written. If there is no will, then it is determined by the common law of your state, and you'll have to ask an estate attorney.

IF there is no will, and the other 3 kids truly have no one to pass on their inheritance too (and the deceased has no spouse) it would go 50% to one 'family" (aka one of the children) and 50% to the other. So, say that 3 of the kids belong to one child, and 2 to the other. The 2 would split the 50% so they each had a 25 percent share. The other 3 would split the other half, so they each would have a 16.66% share.

Its unlikley it would go equally to all 5.

However if there is a will it would go to whomever it stipulates.

After the estate expenses are paid, the balance of proceeds would probably be shared equally amongst all dependents unless there is a legal reason nto to.....
