My neighbour says she was named in an Uncle `s will .She said he went to live abroad , and she has not heard from him in ages. She has written ,but had no reply.She is sure he must have passed away as they were really close .He had no other family so can she find out 1) Is he deceased 2) he lodged his will in this country so how can she find out where.?
She said she did not like to talk to him about when he died what was going to happen as she did not want to think about him dying.Can anyone help ?

The Uncle lived in South Africa,but neighbour knew that the will was lodged in this country (UK )

This is highly complex, as your uncle's will was made in the UK and yet his assets were probably in South Africa. Moreover, as there was no further contact with him, there is no knowing whether or not he made a later will. He really should have made two wills, one in the UK and another in South Africa if his property was spread about both jurisdictions. The uncle might have died long since and his executors in South Africa could have advertised for her without her happening to see the advertisement, in which case all the uncle's estate might fall into bona vacantia, i.e. property that is unclaimed or that has no known owner. However, I think this is unlikely, as if your friend continued to correspond to her uncle, then her letters would be among his effects and whoever was dealing with his estate would be only to grateful to have her name and address as a valuable lead.

We need to know which country your neighbour's uncle was in and where he moved to to answer this question. In the meantime, bear in mind that he may have written a completely new will after he emigrated.

Edit: In Scotland, wills are registered at the Registers of Scotland, so that would be a good place to start if he was domiciled in Scotland when he made the will. I have no idea about other parts of the UK.

i wish your neighbour the best of luck as this happened to me last December and i am just going round in cicles with the whole thing and it is costing me a fortune,first contact his old address and find out if he is dead,who conducted the funeral?as this has to be done within 48hrs of death,then search for his will,someone may know,

Your friend need to get a private investigator and/or an attorney involved in this. The information will be difficult to get on her own.
