It appears his mother erased his last name on the brith certificate that hes used his whole life and now finds at 56 yrs old that the name hes always used isn't his real last name. How easy or bad is this going to be in reguards to his SSecurity, army records not to mention whether we are actually legally married after 28 years?
Simple name change or huge legal situation?

I think past is past. Don't care too much.

He has lived with his current name all the time. Just live with that, don't ever change it even though it's not his true name. You will get more trouble if you do that.

Like others said, it's just a name, nothing important behind.

a complicated issue for sure.

Firstly, contact the city or town he was born in and get a New copy of the Birth certificate. It is the record on file at the Town hall or city hall that will determine his real last name.

If there is a difference in the names....How could he have acquired a drivers license, ss number or marriage certificate?

You may need an attorney to sort all of this out in the end.

Clarification: did he use the same Birth certificate for 56 years?

The town records will have a copy of the original...either a photo copy or a digitized computer copy.

Why does he have to change anything. He's gotten by this far, with the other name, why cant he just continue the exact same way he always has. If the army didnt notice, and the social security office hasnt noticed and the irs hasnt noticed, I'd think it's safe to say to leave it alone. He's 56, I think he can live the rest of his life the same way he's lived the last 56 years. However, I might do a little research to find my real father.

I am not a lawyer, but I'd start with a call or visit to your social security office. Bring his card, the birth certificate, and any other forms of ID that you have. Bring Army discharge papers, too, if they are convenient.

This might be nothing, or it might be a major hassle. Either way, you'll want this taken care of before he reaches retirement.

Is mom still alive? Is there a reason she did this?

Confusing. In order to get things like a drivers license or social security card, you need to show your birth certificate. How did he get those things without it? Maybe his mom changed his name legally. Id call the county court records office.

I don't know. It sounds like you should talk with a lawyer who specializes in name changes, etc. Wow. Maybe you could just continue as you have been. He is 56 and alls well so far, right?

Hire an attorney and legally change his name to what he has been going by all these years. It's easy.

Call an attorney who handles adoptions, name changes or SS cases for a couple of C notes he or she will give you better advice than you'll get anywhere else.

Same with my husbands....
But we work out all the papers...
And yes, it was waste of time..
But,definetly the fact it will help
a lot for the persons sake
But it surely, never late than never..
