it has small marks and wholes in th window but is bit bigger having bed and nice sofa, but is on a weared corner location where trong smell of cigarette comes. what should i do?

Go with whichever you think you will like best. You could ask to have the window fixed before you move in to the other if you decide you want to move into the other. Febreeze should help get rid of the cigarette smell unless it's coming from somewhere outside the other apartment. Normally when you move into a new apartment you also write down on the lease what all was broken when you moved into the place so you don't get charged for it when you leave.
