70% of American companies are doing background checks for education, past employment, and criminal histories. This is primarily due to the events of 9/11.

Before 9-11, I worked in a nursing home in human resources. We were required by state regulations to conduct criminal background checks on all employees. I don't know if it is done the same way now, but we contracted an outside criminal background investigation company, provided the social security number and the places they lived in. The research would check with the local registries and verify whether the person had any convictions on their records.

But we could only do this on a person we decided to offer a position to. We would get a release form signed by candidate. That way, we had their permission in writing to obtain that information.

Most of them hire background checking companies like Choicepoint, etc. They take this very seriously, because they must keep their staff safe. Most also drug test.

Typically they check databases using the name and Social number for convictions.
