i am a defendant in a court case. the prosecuter had a false witness testify. she is a social worker that testified that she met with my wife and children on numerous occasions, when in fact my wife has never met the woman. she provided false testimony and therefore purjured herself. should the case be dismissed? This fact was not realized untill court was in recess when i spoke to my wife.

and easily proveable, all i have to do is ask her to point out my wife. she was sitting next to my wife outside the courtroom and has no idea who she was. so not only does my wife not know her she doesn't know my wife.

Not only grounds for dismissal but it's also a felony, and in some cases is a crime, obstruction of justice, and all parties involved should be prosecuted accordingly to the full extent of the law..☺

Definitely, a false witness is a ground for the dismissal of the case if the defendant could present evidence in court as provided for in the Rules of Court.

It is only false witness if she knew what she was saying was false. If she met your nanny and children or had met your children on numerous occasions, then she could still be in the clear.
Will innocent people be harmed by the actions you take to shed light on this false testimony? I'd weigh that into your decision. Best of luck, friend!

Ok, you know it is a lie, but what proof do you have. it is only purjury to the court if you prove it is.
So not meaning this wrong, the court is not going to take your wifes word, So you can get your wife called as a rebuttal witness and say that she never meet with her. but no at the best you can only get a mistrial, so they can recharge you, not dismissed.
So while you say she is lying, unless she admits it, you now prove it, with evidence that the court will accept

You would htink so, but unfortunatley for US citizens The law does not work the way it should.
I went to court a few years ago, and watched a police officer lie to the Prosecutors behalf. What Could I do? I still dont know.
Sad, these people have to live with their shame of screwing up soemone elses life.
You should push it though. Make a complaint talk to a lawyer first. You dont like his advice, talk to another one. Dont get railroaded - too many crooked people in the system looking for glory for 15seconds in a small ---hick town.

Your attorney will need to impeach the witness.

I don't think the case can be dismissed, but the judge can declare a mistrial, and the case would be tried again
