my wife and I have been separated for almost 3 months, she isn't willing to go to counseling or anything positive to save the marriage. There is a child and land involved.

You should file. It makes no difference in the property settlement, but it will get the ball rolling if that is what you want.

Talk to a lawyer. The person that files first usually has more time to prepare than the person that files second. The best prepared case usually gets more consideration. The one who files first usually doesn't let the other know until after they have their ducks in a row. The person that files first usually gets to chose the judge that presides over the case... There is an advantage of filing first.

Yes it is better for you to file for a divorce cause if you don't and she files first then it looks bad on you and it could even effect the children in who gets to keep them and if you don't she could take all your land and you would be left with nothing trust me i know my friend is going though a divorce and he lost everything but his bed he had to pay 60,000. to her and for the divorce all together.
