i mean if it's working properly, fairly new, etc...?

I agree with previous answers that you should verify user feedback ratings prior to making a bid for an item.

Also keep in mind shipping costs. Some users will dramatically undercut the price of the item only to overcharge you on shipping. Sometimes, you would come out cheaper if you were to buy it from the store.

Another thing... given that the more an iPod is used, the less of a charge the battery holds, you might want to consider buying a "new, in-box" iPod from someone rather than used since you'll never know how many battery cycles it has used already.

Are you a student? Apple gave me a 10% discount when I bought the nano when it was first released.

Nothing will ever bring the security of buying the iPod from a trusted retailer, such as Circuit City. However, if you cover your bases, buying on eBay can be successful.

Make sure the seller on ebay has a good feedback record and is selling the item new.

well it would be better if its new. You should buy it from someone whos selling lots of stuff and they are new because its safter then just a person that wants to sell a used thing. (it might be safer to buy from a shop) but ebay is okay as long as its new :)

you could get a new one for $20 less than the retail price at places like amazon or circuit city.com

but to answer your question: the warranty might be out and you can be SOL
