If you were to commit a crime, say murder, at 2am when BST ends, and you had an alibi for 1am, would you get away with it?

No. During the day when Daylight Saving Time ends, there are two 1 AMs: 1 AM EDT (Eastern Daylight Time--or whatever it would be for your time zone: EDT, CDT, PDT, etc...) and 1 AM EST (Eastern Standard Time). They are separate and distinguishable hours; you can not hide behind that particular technicality (it has been tried and defeated in court too many times).
