No. We need to stop making every little thing illegal just because some people might create a greater risk by doing it.

Cell phones are just one of a hundred things people can be doing that impair their driving. Do we pass separate laws for cell phones, eating, putting on make-up, talking to people in the back seat, having children in the car, taking notes, singing to the music, etc. etc. etc. etc. etc.

We should punish the people who cause accidents, and increase penalties if they were doing something stupid or reckless that caused the accident. But we shouldn't punish people who didn't cause accidents just because someone else might have.

That being said, I wouldn't mind a driving test for people who think they can talk on the phone and still drive coherently -- but cannot. Again, make it a sentence enhancement if you are pulled over for some other reason, like seat belts used to be. If you haven't gotten the license to drive and talk, then you get a second ticket.

Yes, studies have shown that talking on a cell phone is worse than driving drunk. You shouldn't do anything that distracts you while behind the wheel of a three thousand pound pile of metal and plastic going 75 miles per hour down the freeway.
