I have a friend that wants a divorce but says she cant because it is illegal to get one while she is preg. The baby is not her husbands either. Im thinking this is just something she made up so she doesnt have to deal with it.

It is illegal to get a divorce in Texas while pregnant. Regardless who the baby's father is, she will have to wait until the baby is born and the court will want the husband and her to sign a paper saying he is not the father. If for some reason he doesn't want to sign it, then the court will order a DNA test. If the baby is not his, if I was here I would leave the "father" section on the Birth Certificate blank, until after the divorce and he either signs that paper or a DNA test is done. Then add whoever the father is then.

Courts will not grant a divorce in Texas until the pregnancy is terminated. Your friend will have to wait until after the baby is born to finalize the divorce.

I doubt seriously that this is the law in Texas. It isn't in any state I'm aware of.
In the first place, divorce often takes longer than nine months anyway, and in the second, the decree will recognize the pregnancy, and declare the child to be his responsibility as if it were born during the marriage.
I think this may be an excuse your friend is making.

Yes, it is legal .. Being pregnant with someone elses child simply means that wife cannot ask for any child support...

It is true. In Texas they will not allow a divorce if you are pregnant no matter whose child it is. In the eyes of the law it is the husbands child until proven otherwise
