got banned last wednsday but looked at charge sheet and realised that the car reg was wrong. can i appeal or is it to late. technacally i pleaded guilty to an offence of driving a car that i wasnt.
any help is appriciated

The error in the summons was not a material error. The long and short of it was that you were caught driving with excess alcohol in your system and it doesn't matter what particular vehicle you were driving, you shouldn't have been on the road. The offence to which you pleaded was not one of driving that car, but of driving. It would be utterly futile to appeal against conviction and if the Crown Court decided that the appeal was frivolous and vexatious (which it would be) you might find yourself having to pay a hefty bill in costs. Just leave it well alone.

I believe in the past similar cases like yours have gotten off on these technicalities. If the police officer has taken down a different registration number then you have a good case to appeal. The registration number on the charge sheet refers to a different vehicle and person AND that person isn't you. Ask for legal advice - I'm not sure where you stand if you have already pleaded guilty to the offense.

If you do get off - listen to what these other guys have said. Learn by your mistakes don't drink and drive - its not just your life you are putting at risk but everyone else's. Road deaths change families lives forever, both victim and perpetrator.

Maybe if you had noticed this a week ago and you had the finances to employ a lawyer who specialises in getting guilty people of the hook then I would of said there might be a chance.. but now you've pleaded guilty I would say.. not a hope in hell!! and you know what??? I'm glad!!!

I wouldn’t think it matters what car you were driving - if you have already admitted to: 'Driving/Attempting to Drive with excess alcohol' or 'Being in charge of a motor vehicle with excess alcohol' etc..& presumably the breath test confirms this together with the police evidence.

Quit trying to find loopholes and take responsibility. Wrong car maybe, but they charged the right person. That is all that matters.

I would not bother - although there may be a misprint and you might be able to get out of the punishment I would consider that to be a very low thing to do morally speaking.

Drinking and driving is the most stupidest thing you can ever do.

If you were drunk, it doesn't matter what car you were driving, you were still putting other peoples lives in danger and you should be happy that you didn't kill anyone. Hope this tought you a lesson.
