she applied for maternity leave but our HR rejected it saying molar pregnancy was not a pregnancy but a disease. but her doctor said otherwise. that she got pregnant but the pregnancy was abnormal and got a disease. her biopsy was ok she did not have cancer. can you help us? we need to know more about this molar pregnancy for her appeal for reconsideration. is there anybody out there who filed for maternity leave who had molar pregnancy? our law states that any cases related to pregnancy can avail maternity benefits.

Why would she need maternity leave? She is not having a baby. Molar pregnancies are when a sperm fertilizes an empty egg, so a baby does not form but the placenta does and goes OR when two sperm fertilize one egg and the fetus and placenta will both be abnormal and the fetus will not survive. Again, she is not having a child, so there is no need to take off 6+ weeks to take care of it.

She should be applying for extended sick leave or a disability leave if she needs to take some time off to take care of herself.

If she is having trouble getting health benefits, I would just assume that it should fall under gynecological benefits.

Maternity leave is usually reserved for mothers who have to take time off to have a baby. It's usually taken beginning near the end of the pregnancy and lasts for a period of time after the delivery so the mother can recover and spend time with the baby. I don't know the specific rules where you are, but I doubt they apply to a molar pregnancy. A molar pregnancy is a rare type of miscarriage in which the fetus develops chromosomal abnormalities and is unable to survive. In addition, the mother is at risk of developing cancer from the molar tissue. The pregnancy has to be terminated as a result, and the mother must be monitored regularly for a period of time to ensure there's no regrowth of the molar tissue. During that time the woman can return to her daily life, including going to work, so there is no need for special medical or maternity leave.

If she needs time off for any medical reason, and her company is within the legal obligations to provide it (like she's been there atleast a year, and her company is a certain size) she can apply for FMLA (Family Medical Leave Act). I think she'll need to fill out paperwork, and need medical statements from her doctor documenting that she needs time off. What this will do is allow her to take up to 12 weeks off, her employer has to hold her position or an equal paying positon. They are not required to pay her for this time off, but just hold the job. She can use any vacation time, or sick pay but once again the employer is not required to pay her for the time, just hold her job. THis is usually where maternity and paternity leave fall under anyway. Something important to know about it is that the 12 weeks is a total amount for a year. So if she takes the full 12 weeks and gets pregnant, she'll be out of FMLA time for the year. If she gets pregnant or has to have any other time off later on, she'll be out of luck.

Have your friend to ask the HR people about FMLA time and the paper work required.
