I know of a situation where the mother of a 3 yr old has made false accusations of sex abuse. Is there any recourse to sue her?
What can be done ? She has a temper problem but has not physicaly harmed the girl but I don't know what she has said that might be abusive. What can an innocent man do to defend himself from blatently false accusations like this.
I think a woman making false accusations is just as bad as the thing she claims is happening.

I am paternal grandma, acusation was that my sons roommate did "something" but she only used this to manipulate my son to move. I am tracking the things she says but son is afraid to 'make things worse' if he fights her.
and I want to clarify that I did not mean her false claim is as bad as actual sex abuse just that it is just about the worst thing a woman can do. He hopes to eventually get full custody but is not yet ready to make that move. She also refuses to get a job or work on getting a GED and her mom is the real caregiver, she just visits.

Well, I'm not sure if I agree with you that the false accusations are as bad
as the thing being accused, by I agree that the entire system starts to
crumble if people use lies to manipulate it.

Yes, she could be sued for libel, defamation of character, particularly if you
can show material losses because of it (i.e. if you lose a job because somebody
here's this, you can claim the loss of income, etc.)

Trouble is, you have to prove it.

Generally, the only thing people care about with these issues is
custody - so don't assume that suing her will slow her down.
You could make the argument that her lying makes her an unfit
parent, but again, you have to prove that she is lying.

Recognize that in custody battles, it is ... well ... its normal for people
to accuse each other of bad parenting - it really becomes an issue
of how far they "stretch" the truth about it.

However, husbands and wives enjoy no civil or legal immunity for libel and can certainly be sued.

That is so disgusting, but the proof is in the pudding. It is very unfortunate but her daughter will suffer the most because they will do a physical exam to see nothing has been done, but that is traumatic enough by itself. Definitely keep a written log of every time you are with the the child ( if any) and try if you can to always be around someone for a little while this situation works itself out.

that is a very serious accusation if you can some how maybe get her to do a lie detector test to prove yourself, maybe a lawyer can set it up to get one done, after proving her wrong than sue her butt, for all the pain and suffering being accused of sex-abuse.

that i think would be the only way to prove it other wise and physical examination as well. to prove your innosence fight for your rights don't let it go.

all the best
