As far as I know, women cannot be prosecuted for simply being topless in public in NYsince the mid 1990's (before my time, but I believe it to be true from one of my undergrad classes) if a man cannot be prosecuted for the same action. Prosecution can take place if the topless woman is showing her boobs for lewd or immoral purposes (whatever that standard is) or if there is a local ordinance that has been passed banning such bare breasts. In the latter case, it would probably be challenged in court by the accused girl.
In reality, more and more girls and women are going topless at regular clothed beaches every year, going topless in co-ed saunas, etc. and even sunbathing topless in some parts of public parks (particularly Central Park in NYC). That's probably the extent of it...you won't see many girls walking down the street topless or going into 7-11 without a shirt. Maybe someday, but not yet!
I'm 21 and live in NY (on Long Island) and go to the nude beach here, so topless is never a problem because full nudity is the norm, but a number of my female friends have started going topless at Jones Beach and Robert Moses (two regular "clothed" beaches) without any problems.

Yes, in New York City, but they have to be in an establishment that is licensed for topless dancing. I think there are a lot of rules as far as zoning and other issues. I believe there are topless bars located throughout the state.
I also heard that there was a court case that said women can go topless anywhere in NYC. I'm not sure if this is true. Unfortunately I haven't seen any topless women walking down the street.

i think they passed a law stating they can go topless but as long as noone complains. im not 100% sure, but i did hear that.
