If the papers have been signed there is no need. My ex had left the state by the time the divorce went to court. I was there!!! so everything went well.

In Illinois, as long as the divorce is uncontested and you have an attorney. The ex can just sign the papers, you and your attorney go to court and that's that. The ex doesn't have to be there. I know from experience - Me, my lawyer and the court. I received my divorce papers 2 days later.

No, my ex husband lives in New York, I live in California, our divorce went throuth the court in New York, (actually through our lawyers), NO ONE went to court. We agreed pretty much on everything, were able to iron out the stuff we didn't agree on pretty well. But then we had already divided up the property, I signed off on the house (because I didn't want it), we agreed on division of joint funds, and that was it. Our's was really a pretty amicable divorce, not all are, and those are usually the ones that wind up in court.

Are you trying to avoid the ex?
Say the ex has dropped out of sight, to places unknown,
then the law allows you to post public notice in prescribed ways
and then proceed with the court action -- d-i-v-o-r-c-e.
See if your local courthouse has a do it yourself divorce kit,
or see a lawyer. For four hundred bucks you don't have to go either.

after a public cry has been issued 3 times the court will grant a divorce all you have to do is go to the circuit clerks office and make sure its on the books

Please consult the proper court for your location. In MD, my ex-husband was not there. I did have to provide proof that I served papers. He signed them and sent them back to me. I brought those papers to court and was granted my divorce. Also, the divorce was not contested.

If you are asking if the person you are divorcing has to be there...the answer is yes.....you can't divorce someone without serving them notice (called a summons)

When I got divorced my attorney told me my soon to be ex probably wouldnt show up. But, he was there. So I guess he didnt really need to be there but was there.
