Ok here is the scoop long story short.
My friends x-girlfriend got pregnant by him,she wanted an abortion,so she got an abortion.She later regrets having the abortion ,she wished that she would have kept the baby.People ask of why the two broke up,He says because she had an abortion,"She aborted his child",so he broke it off.being that she regrets it,when people ask her what happened in the relationship for them two to break up,she is telling everyone that he pushed her down a flight of stairs and she had a mis-carriage.Saying that he killed the child when this never took place.There is proof she had an abortion(Medical Records).The boyfriend owns a local business in town,which may hurt his reputation.Is this name slander,can it be taken to court.

Absolutely! If you can get the proof.......... I've been told that some of those abortion clinics are hard pressed not to give out those medical records, however that could have been the old system. Absolutely the ideal case of slander. Sounds like she needs to be thrown down a flight of stairs! Poor guy, I hope it all works out for him.

Yes, and he needs to contact an attorney immediately and ask for a cease and desist letter to be drawn up and sent to the ex-girlfriend. The friend will need proof that she is saying this about him, the documentation of the abortion, and names of people who will be willing to testify in court, and a case can be brought against her for defamation of character and slander. This is really twisted of her since she was the one who decided to have the abortion. Something like this could hurt his business also as he well knows.

I don't suppose it ever occured to the man to just say they broke up? Did he have to tell their business to everyone? No wonder she feels as if she must deny the abortion, in most places abortion still carries a heavy burden of shame and regret. She is wrong to displace her guilt this way, but he was wrong to put her name out there, opening her up to the pro life nut jobs out there who like to call people up and harass them. Neither one of them has clean hands in this. She might actually have a stronger case for slander if he has gone around town telling everyone that she "killed his baby".
Just see what you got for an answer to this, all those people who care so much about the life of the baby are suggesting that she be thrown down the stairs now.
Disgusting.

Yes, this could be classed as slander. Any derogatory remarks about a person, which have a knock-on effect on their reputation, can be classed as slander. If your friend's business suffers as a result of his ex's remarks then your friend does stand to earn compensation for this. There is most definately precident here. However, if your friend does not lose out on any business and/or his reputation has not been tarnished, I don't think a lawyer will see any point in arguing his case.

Oh my God! Why is she saying this? She must be insane!. She does'nt seem to understand,that someone is liable to believe her story,contact the police,and he could be arrested for "Battery,and causing the death of a child. (Now) If she claims this happened,then the police will want to see Hospital/Medical Records,that states she lost her child as of the result. Because SHE CAN'T PROVE IT HAPPENED,then he can take her to Court,for "Defermation of Character" (Slander). She is incrimination his good name,and hoping people will fill sorry for her. She had an Abortion,and she's ashamed of herself,and now she wants to inflict her pain on him? "YES"'!". Tell him to take her to Court,and for him to ask his Lawyer,is it "Legal", that an unmarried woman can have an Abortion,even though the father wanted to child?

Actually it is Deformation of Character. He could sue her if he can prove a loss from her statements.
Tell him to get a copy of the abortion paper work and hand it in the window of his business.
With a sign saying this is how so and so lost the baby she was carrying. See how she likes that.

If you as you say have proof, get a lawyer and go to the police. If she files a report, or anyone else hearing the story could also contact the police, you can put a stop to it before it anything happens.

I would not take this lightly, all you can ever pass down is a good name.

I would depend on the statute, but in order to prove slander/defamation/false light and the like, you usually have to prove that the person has sustained damages. If he can show a negative effect on his business, then he could have a case. He should consult a lawyer.

in case you may conclusively teach that he lost business employer and tangible money from her movements she would be sued for defamation. it relatively is not sufficient to show she had an abortion, to boot scientific documents are sealed and basically attainable with a warrant. in case you prefer to sue her you need to show that he lost something tangible by using her claims.
