I am an esthetician. Confused about what this really means....

I work at a spa, I do skincare. Are there laws to protect my rights. Or, does my contract that I signed tell it all? Is it true I can make up my own hours? etc...

Hello,

My employer uses Independent Contractors to work on some of our contracts (we also refer to Independent Contractors or 1099s). When we'd like to bring someone on as an IC, I issue a formal agreement between my company and the IC which outlines the relationship of the parties and the rights that each has.

Due to IRS regulations, we have to be very careful to distinguish between an employee and an independent contractor. Were you issued an agreement? If so, that should outline each parties obligations to the other. If you can provide a bit more information as to a possible predicament you may be in, I might be able to help a bit more.

An Independent Contractor has the right to work 1000 hours per year. More than that and you are no longer a part time employee. Then the company has to treat you as a full time employee by paying half of your social security and take your tax and medicare deductions.

Being an Independent Contractor can be good and bad. You can usually find work, but at tax time you are personally responsible for paying all of your Social Security and taxes yourself. (A company as I said before does not take deductions to pay these Items for you).

You are not an employee therefore you have no employment rights.
