Our council will not remove our refuse unless we leave the wheely bin where they tell us, this could be on the road or pavement, my question is if we leave the bin where they tell us and it causes an accident who would be held liable?

If you think where you leave the wheelie bins is going to cause an accident why not get in touch with your councillor or the council direct and explain your concerns and offer a solution?

Tell the council to sign a paper stating that he or she will be responsible for the bin. If he refuses to sign tell him to physically put the bin there him or herself and make sure you have a witness.

since your acting on the councils wishes and the wheely bin wouldn't be there if it wasnt for the stupid council and their stupid rules, then its the council. you havent puposely caused an accident.

A lawyer could argue six ways to Sunday but I would argue that The Council would be responsible. But then when has Government ever been responsible?

I would say the council because your only doing what they are telling you to do. If it's the only way your rubbish will get picked up then it's not your fault.
