he was ordered to pay me each month for the rest of my life. if he was working they would take it directly out of his checks, but since hes not can i get it taken directly out of retirement or soc sec.

he is retired now, drawing retirement and soc sec payments, lives at his mothers house.just wondering if i can legally get it taken directly out of his retirement or ss

Well I believe you can...My mother was in the same situation as you...In the divorce papers it stated my father is to pay my mother for life...but he stopped....anyway she spoke to a lawyer and they told her if it was court ordered he has to...all she has to do is take the papers to the DA and it will all be taken care of... he will be surprised shortly...but I'm not to positive about retirement or SS, but I do know she is entitled to them...So if it was court ordered your should be able to get it...

I do believe he still needs to pay a portion but no where the amounts he did when he was working do you really have to
run him dry do you work if not then maybe get a job all I can tell you ask a lawyer but you may out of luck if he is only bringing in enough to cover his costs of living.

I believe this answer to be no. If he is not working then the amount that he should be paying goes into an arrears account that should be added to each of the next months in increments not to exceed an additional 15% of the original amount until he has the arrears paid in full. Also the amount that is in arrears can have interested added to it not to exceed 17%APR. (these percentages vary from state to state)

You will have to consult a lawyer or take it to court. He will either refuse to work or work under the table just to not have to pay you. I know someone who is doing the same thing with their child support payments. Get him to pay.

Sure, you can sue him. If he owns any assets (car, house) then you might be able to go after those too.
