We both agreed on divorce, but in state of maryland you have to be separated for a year before you file for divorce. we both agreed on separation but we haven't file any official paperwork for separation.

I am not a lawyer. But I can tell you what I know.

Divorce laws are different in different states.

In Maryland, you can do whatever you plan to do after divorce, right now. Instead of divorce papers, you will have separation papers. You can live separately and have your own independent life. You can even live with somebody of your choice. The only thing you can not do is to remarry during that one year period.

But if you do want a quick divorce, one of you should move to Nevada and establish a 90 day residency. It has to be a real residency, for example, open a bank account, register you car, get a drivers license, sign an apartment lease, etc. Then you can get a divorce in one day if both parties are present in the court and sign the necessary papers. If it is a fake residency, your spouse can go back to court, always reverse the judgment, if he or she wants to. After the divorce, you do not have to continue to live in Nevada.

In NYS you not only have to be separated for two years you have to undergo counselling. Counselling is certainly a good thing because most exes can never stay apart from each other after a divorce especially if one of the exs find another partner. That means that people need an excuse to have a relationship. So the marriage counsellors try to discourage the divorce citing this kind of thing. If I was a marriage counsellor I would encourage divorce because that would be the best thing to bring them back together. I hope I make sense. All the divorced women say their exes always use the children to get back to them. Exes never stay away from each other. Married people can't stay with each other.

In MD you don't have to file the paperwork for legal separation unless you need to prove legal separation for things such as getting welfare benefits. You will need a witness at the divorce proceeding to prove that you and your soon-to-be-exhusband were seperated for the year.
