A friend has passed away. He has no children or spouse. He does have a will. What is probate all about?

since there is no next of kin, the court has to legally make sure that his estate is going to the right people...could take awhile...alot of courts are backlogged with these kinds of things....they al;so make sure his debts aere paid before anymony or items are given to someone else

depends on what state you live in and the laws...first of all everything should of went to the state being no one involved. everything is documented by the courts.when his belongings, money , property etc. were left behind : the courts, attorneys, financial authority all want to make their share of prophets from anyones estates..taxes, etc has to be paid along with how much everything was worth...you need to check with an attorney for legal advise or rules..usually this is free of charge, being it only takes a few minutes of their time...

*PROBATE* is merely authorizing THE JUDICIAL SYSTEM to oversee the final wishes of the deceased by their (the govt.'s) guidelines. - This has a prominent "limiter" as to how much of *the estate* can be distributed.
As "our system" here, in the USA is organized, a person's "final wishes" are highly scrutinized, because often (in multu-billion-dollar estates) the wishes are distributed tax-free.
This ^ way, the Govt. has no access to these funds....... leaving it out in the cold.

It was my understanding that probate is what people draw-up wills to avoid.

Any legal-eagles here who know the facts?

The Gov. is in everybody business they want there fee there cut of the money so they can fill there pockets first.that's the only reason I know.

This is in case their are any outstanding bills against his estate, or any distant relatives who want to file a claim.
