You can try a pro-bono lawyer. But ultimately you will have to pay this fee, unless your atty makes your husband pay it. If you are doing the legal work yourself - you are stuck - to the best of my legal knowledge.
I am in Illinois getting divorced too! I have to say the legal system has been very very strange, allowing my husband's atty to cancel cancel cancel!! Best of luck!! Hopefully you are not in the chicago suburbs!

What she might do by herelf is go to family court and demand spousal and child support plus all medical expenses for the kids. He can't avoid it, and she should demand it from the day he left. Additionally, if she wants to do it another way, she could file separation and for child support, med payments and spousal support in full by doing it Pro Se with the county she lives in, which means representing herself from what date and say he's abandoned them all and ask for legal separation. If it is over one year, she could ask for a straight divorce. She MUST read The Divorce Handbook, in any case, and if representing herself, have a computer generated list of what she wants, outlined in the book, and spelled out in xeroxed copes for the Court and the other sided, keeping at least one full copy for herself. She can if she is very organized and intelligent. Be assured hubby cannot get away with not paying child support and maintainance for her. However, if she can get a young attorney to do it all for a preset fee, lets' say 10 grand payable in full over a year or two, she could be on far better grounds than doing it herself. Make SURE the lawyer knows how to Get a divorce and is not afraid of a Judaical hearing and has some backbone. Also, some young law students From a law college within a university can sometimes help out without a lawyer. He will certainly get a great lawyer. Also, he could be deemed criminally responsible for non payment of any support for the kids, and if he refuses, she could and SHOULD have him jailed. If he is jailed, the money keeps adding on for the time he is in jail, plus he is secretly charged room and board by the county. She should say nothing about that to her husband. Let him find out the hard way. The Divorce Handbook, coupled with the book Creative Divorce and the book Rebuilding When Your relationship Ends will help. Join divorce support groups. In fact, if she attends a few of these groups and ask for advice, she'll get some good advice free, usually.

My county sets the filing fee for divorce. You cannot file in that county without paying the fee. As far as I know you must file in the county where you live, so you cannot get away from that fee.

I don't know of a way to NOT pay the fee, but if need be, borrow the money, file the divorce papers, then work the money out and pay it back. It could be the easiest money you ever paid back in your life.....SO worth the effort.....was in MY case! Good Luck!!

You can't someone has to pay them, and it needs to be you or your husband, they have all those fees for reasons and they need to be paid...good luck
