the offender is under psychiatric observation be considered as a defence in the court ?

Couple of days ago I asked the about domestic violance, but I did not mentioned the fact that the batterer is a mentally challanged( I don't know the proper wording, my appologies.)
Defender says - No, psychiatrist says -Yes. Both are for money, that is understandable.
So I am very curious.
Any ideas? Thank you in advance, Kat.

i think him being mentally challenge would be in consideration. But it also will be determine how severely he/she is. If he/she is very servery mentally challenge then maybe he Will be put into a mental institution BC he is a danger to society. So it all depends on how severally he/she is on what the judge will say. If it is a jury that is gonna do it then it could go any way. they could fine him totally Innocent or not. but it depends on how server it is and if the Judge is doing the judging or if it is going to be jury.

if the defender is your mate you should know this. don't let that stop you if your being abused. they the courts take all that into consideration.if the defender is mentally challenged maybe/ now your physically and emotionally challenged? go to www.mentally challenged.com or www. mental health.com and put in your question. thanks Kat

consideration will be made depending on how severely challenged the person is --- if they can't control their actions, then that person may be put into some type of care facility or group home.

it can be yes,,but the sufferer should be on some sort of medication to combat the symptoms of his illness,,you cant just say,,oh,,he isnt well! it also is not an excuse for hitting another person either,,if he is endangering another person he should be given help or sent for further assessment.
