we get 4 weeks anual leave.but we are told we must save 5 days to cover xmas because the company closes down for nearly 2 weeks.but over the last 2 or 3 years we feel we we have lost a couple of days.for instance this year we finish on friday the 22cnd of december,and return to work on tuesday the 2cnd of january.christmas day and boxing day are bank holidays.they are on monday and tuesday.so we are only getting wed thur and friday as holidays.after theses days you have saturday and sunday the weekend obviously.monday his new years day we are back in on tuesday.we have saved 5 days,we are only getting 3.are we right.we get all other bank holidays off.if we are correct his there any thing we can do.are can the company pick and choose bank holidays.help.

So 20 days annual leave, plus eight bank holidays minus 5 days for the christmas period. still leaves 23 days holiday. Doesn't sound too bad to me.

Legally an employer must give a minimum of 4 weeks annual leave - BUT this can include bank holidays - so the legal minimum then becomes 12 days - a bit disgraceful I know, but quite legal.

I do think you should question where they get 5 days for the Christmas period - bearing in mind the number of bank holidays. My employer asked for two days to cover Christmas this year and we too close on 22nd Dec, returning on 2nd Jan.

The company can choose whatever they want to. I'm a machinist with a small but world class shop and we get less holiday time than you do. We get 2 paid days for X-mas and Thanksgiving weeks, we also return that Tuesday after New Years, and 3 unpaid for those weeks, we can use PTO time if we choose or take them unpaid. Also we accrue PTO time but cannot go under 24 hours for vacation leave, we have to keep that much time in case of sickness. I think it is our time and we should be able to use it how we want. Our holiday schedule is one day for memorial day, one for labor day, on day for 4th of July, Presidents day (only because it falls halfway between New Years and Memorial day), and the week of Thanksgiving and X-mas, thats it. We start out, by accrual, with 3 weeks of PTO time, after 5 years it goes to 4, after 10 it goes to 5 and it caps off at 6 after 20 years of service.

Oh yeah, if business slows down a little they may call for a shutdown of a day, which is a decision of PTO or not, or they have "crucial" days where only "crucial employees work, maybe special projects or parts that are backed up and force everyone else out. See you are not the only employees who get it crappy. Don't get me wrong, it is a great place to work but we get it handed to us for holiday schedules!

You need to have a look at your contract.

The legal minimum for holiday in the UK is 4 weeks (20 days for a full time employee)

It could be in your contract that bank holidays are included in this, in which case they are within their rights to do this.

However, if bank holidays are supposed to be on top of this, then they are only giving you 18 days, which is breach of UK employment law.

I think the xmas and boxing days should not be counted as part of your annual leave, unless you have signed in your contract to say as much, so check it over. Then get onto your union, HR dept or citizen's advice and kick up a bit of a stink!

some companys wont except the tuesday as a bank holiday so look into that one, I know my company doesn't. But then I do feel you are still missing one, all rally round together and confront your boss on the issue together, he wont be able to back out of it so easily then!

It certainly does sound as though you are being tucked-up. You need to check your employment contract if you have one, and if you feel that your rights are being abused, then approach the management with your queries and persist until you get a reasoable reply to your questions, and a settlement of the problem once and for all.

quit complaining i don't even get 4 weeks off, and i work 4 the same co. for 6 years!
