The courts want the men to work as many jobs for as many hours a day as is humanly possible to keep their ex-wife from working. This way the woman is "home" raising the kids. The system makes the father of the kids odd man out.

Because the system is set up to protect the women. Because some dumb behind man felt that children need their mother more than the father. Also men don't carry the baby for nine months in their belly, some men just plant the seed and walk away.
P.S: If women ever really get Equal Rights, maybe custody will be settle on a case by case basis. Instead of automatically assuming the woman is a better parent.

years ago the courts believed that men could not raise the children on their own so it was automatic that the woman got the children. as society leaned and changed so did the courts , now more and more divorces end with joint custody. primary residence is given to the one who can best look after the child ever day needs. and more men are finding that they are winning in that area. also the court now more then ever is taking the needs of the child into considerations. many children ages ll and up are being asked with whom they wish to reside. and its being accepted by the courts. so yes fathers used to loose a lot but in today's world that is not a given any more

Typically, men don't go for custody. It is documented that abusive men WILL go for custody and WILL win custody. It's a tragic fact in our society exacerbated by father's rights groups who don't want to pay child support. Also, there are some women who use the fact they have custody to "get back" at their ex. The courts need to be regulated to determine what is in the best interest of the child(ren). Shared parenting appears to be the fairest way.

every divorce is different, I have custody of my 2 kids and it was a fight (they are 19 &17) till the end,the judge takes in all the facts and then makes his choice. its like what caused the divorce,who was more guilty in the divorce and does the dad want custody.
they also do interviews with the friend of the court,they talk to kids,both parents its like mountians of paper work and its like who is more information about the kids (friends teachers that sort of stuff) has the advantage. usually not do to with who has more money but who is better settled (who works what hours and who gets the house that sort of thing)

They don't really want them. They only say they do to make the wife go insane or to make themselves look good. Most of the time when they do get custody, the children either go back to the MOther or HIS Mom takes care of them. Judges know this.

Either because the judges think that mothers can take better care of children than fathers or because women are more persuasive than men.

Because they don't make a valid effort thinking they can't win, and/or have an attorney to tells them they can't win, or is unwilling to try. You have to learn how to interview attorneys, and not just hire the first one you talk to.

because babys or children need who take care for them and this is mother job in nature,caring,feeding,dads don't know every thing about kids growing as much as mothers do.
