I'm not sure.
My guess is that the drunk driver is worse, because there is a lazy, sloppy, cold indifference to human life. The drunk does care about people and whether they live or die when he turns the ignition key -- now that is barbarism.
The spouse who catches the married partner in the act with a stranger is reacting violently to betrayal. It's not right but it is understandable.

For me the answer is simple Drunk Driving only an ignorant piece of crap would make the decision to get in the car and drive and possibly risk killing an innocent person, where as a spouse that killed the cheater was drivin to his/her breaking point, doesn't make it acceptable in the least though.

The first killed when he should have had marriage counseling, and the second drove drunk when he should have stayed off the road. One wasn't thinking with his head and the other wasn't thinking at all. Both took a life when they could have prevented it and chosen a different action, and deserve to be locked away for an extra-long time.
Well, what more do you want? If I were the one with the gavel, and wearing the wig, and in the courtroom, you'd see no mercy from me for either situation. Also, I fear that I'd be supporting either situation if I condemned the other.
That's my take.

There is no such of a thing to accidentally kill a person while drunk,it's murder the same as you use a gun, because you know better to pull the trigger of a gun or to drive drunk either way you kill, but a cheater needs there *** beat over and over again every time they cheat, but murder no.

They're both a loss of control, but a drunk driver is worse because he controlled the circumstances that created the problem whereas a person who kills the cheater is thrust into a situation that was utterly out of their control.

I think Both are close on one hand you have the Crime of Passion... (if the person walked out of the room to grab a knife is now considered a premeditated murderer) I think if the person actually inteends to kill another person that to be worse... BUT.. other hand.. People know if you drink drive there is that chance and should be more resposible. So if they take that chance they are almost saying id like to kill somone... EVEN though its an accident... But in my opinion Accidents happen... however if you intend to kill somone thats defently worse.
But both are bad, Remeber if you drink responsibly, you let others and your self live.

This is easy. The drunk driver of course. Everybody knows, not to drink and drive, so this tells me that it is not an accident but premeditated, they just did'nt premeditate the who and when. When they decided to drink and drive, they chose to take the risk of maybe killing another person(s).
The crime of passion is just that, not premeditated in any way. The person just chose not to control his or her emotions.
This does not mean that I condone either of these actions, I do not. There are many people that choose not to drink and drive each and every day, likewise, there are many people that have caught their mates with others and did not choose to kill. Hooray for them for they are conquerers!

Well, both are pretty stupid, but at least in the crime of passion you could argue that the killer was temporarily insane. With the drunk driver, they're just temporarily (or maybe continually) stupid. In either case, you always have a choice...walk away or call a friend/cab.

Drunk driver is worse because he killed a totally innocent person whom he doesn't know and who never did anything against him...whereas a cheater takes a chance, knowing there is a possibility of getting caught
