They cannot take your disability check if that is your only source of income.They can however,freeze your account.In that case you have to file papers with the court stating that the money in your account is only from disability,they then have to release it.It is best to have ONLY your disability income in the bank,nothing else,that way you can prove it is from your disability check.Get your name off of any other accounts you might have jointly with anyone else.I am about to go through this myself,I have a creditor threatening to freeze my account,so I have done research into this.I go to the bank immediately when the funds are deposited and take them out so if they follow through,I have money to pay the rent.

They can't take the money out of the check, but they CAN take it after it's deposited into a bank account. My bank told me that. Your best bet is to just cash the check and keep it out of your bank account.
