many bike riders drive fast. they hit somebody at times seriously.You file a police complaint. You go to court against the insurance company for compensation. But the Bike rider gets away scot free paying at most a fine of rs. 1000 at a traffic court. Is there any way vehicle drivers be punished with imprisonment for rash driving (not resulting in death ) causing greivous injury under the indian penal code. Most often the police take money and dilute the case also. would appreciate if a person from the legal fraternity can give me his opinion too

The rash and negilgent rider/driver can be punished more severely if it is proved to be a case of Hit and run. There are many provisions in the Motor Vehicle act but it is practically not possible to pursue the case and get eye witnesses to substantiate your side of the case. No one would like to get involved in repeated appearances to the court at their time and expense. There is another angle to it. The ride actually hitting the pedestrian or other vehicle may be doing so while trying to avoid collision with a rash driver himself. Have you noticed that the rash riders hardly hit anyone themselves but CAUSE accidents to others? The conditions of some of the roads and the traffic. Less said the better!!
