I wonder if someone can answer me this : my ex-wife is receiving spousal support for the sum of $720. She is an illegal citizen and I am living abroad. What judgement, if any, does the state of CA or the USA have over her if she is officially not living there ?

She is trying to apply for citizenship but her situation looks very bleek...

Who would know ? Any advise ?

As to reference to one of the answers, yes there is a child involved and he is an american citizen. I do pay child support and am very willing to support him until he reaches maturity, but to pay for her, who we believe is working illegal, as many do in CA, and then getting more money from me, I am fighting for ! Unfortunately there is no way to prove that she is working, or does anybody know how to find out if she is working illegally ?

Though she is here illegally, marriage is a contract, and it doesn't become void just because she is here illegally. Because you had a contract with her (the contract being to love and support her), you may owe her alimony, no matter where she is. If there is a court order, you risk contempt of court if you don't obey it. If her circumstances change, and you feel you are paying too much alimony (for example, she marries someone else) then you go to court to ask that the order be modified.

I would ask your lawyer or go to the courthouse and explain the situation. How can you be legally responsible to pay someone who is not even a legal citizen? Sounds odd to me. But you don't want to get in trouble, so take the legal route. Maybe look into legal assistance, just ask at the courthouse - and they should have a program for no cost, or little cost.

She got spousal support!!!!! as a woman who isnt reciving a dime in child support,and nobody is going out of their way to help me get it.....contact the office that issued the judgment and request a reduction in support, chances are they will review your case, and dismiss the judgment. But if you are military, contact the jag, your case is not that unusal to them.

Well i do not think illegal or not makes much of a difference. You married her and suppoerted her and you knew she was illegal. So I think you are screwed and could probley get into trouble if you report her cause You basically involved yourself

She shouldn't be getting any $$ from you if she is not living in the US. Talk to a friend of the court or a lawyer. 1-800-CALL-SAM
