There is none, it was never written to include illegal immigrants and that's the way it should be.
If they want to live and work in the U S then they should pay taxes and work like the rest of us and gain their legal citizenship. It's only fair.
What isn't fair is that they're going to start taking our benefits when they haven't put not one red cent into the system. I've been taxed for the S.S. and Medicare/Medicaid I'll collect when I'm 62 every working year of my life, why should MY taxes go to them when they're ILLEGAL?
And even if/when they become legal, they should receive limited benefits unless they've worked as long as I have and paid into the system as much as I have.
If they want to 'play' Americans then they should 'be' Americans and pay their fair share and not think they can cheat the system. Collecting without paying is cheating us out of our hard earned retirement plans.
They already come over illegally, have babies that are declared American Citizens just because they're born over here, and collect welfare on the child. And that should stop too, if mom and dad aren't legal citizens, then baby shouldn't be either.

Are you talking about the U.S. Constitution and Bill of Rights (first 10 Amendments to the Constitution)? Lots of it applies to illegal immigrants, just like it applies to legal foreign visitors. The Bill of Rights are generally written as proscriptions on government authority, not on rights vested to a particular class of citizens. -- "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech, or of the press, or of the people to peaceably assemble and petition their government for redress of grievances." Where does it say that only citizens are included? Where does it say that legal foreign journalists may be censoredby the U.S. Government, but not American journalists?
Or how about the Fifth Amendment:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
NO PERSON shall be held... Where does it say Citizen? It doesn't.
Of course, illegal immigrants are criminals, and they are not citizens, so they do not have the rights of American citizens (no voting rights, no rights to federal benefits, etc.). But that doesn't mean that the individual rights in the Bill of Rights automatically do not apply.
Remember, Thomas Jefferson wrote that "all men" are endowed by the Creator with certain "inalienable" (not aliens, but meaning not forfeitable) rights, including "life, liberty, and the pursuit of happiness [property, from Locke]." Illegal immigrants are breaking the law, and should pay a penalty if and when discovered. And if they're working here and not paying taxes (and if their employers are not paying taxes) that's another crime, and should be dealt with similarly. But that doesn't mean that illegals are not entitled to equal protection of the laws in other areas, due process, basic human rights guaranteed in the Constitution. You break the law when you speed, but that doesn't mean that Congress can quarter soldiers in your home.
Lucianna -- NO ONE has said that illegal immigrants qualify for social security benefits. The ONLY issue that was raised in the immigration debate this year was, if illegal immigrants DO pay taxes and social security, and they enter a "pathway to citizenship" that was proposed in the immigration reform bills, could they receive social security benefits for the time that they were technically illegal but paying taxes ONCE THEY BECAME CITIZENS (after something like 12 years). The GOP has mangled that into an argument that illegals get social security benefits. NOT TRUE.
In addition, our Constitution defines an American citizen as anyone who is born on American soil. That was necessary since, between 1790 - 1900, many, many many children were parents of immigrants who had settled in America. My grandmother was the child of two immigrants and born here on American soil. I don't know the immigration laws from 1890, when my great grandparents came over as children, but I'd guess that many of the Ellis Island immigrants weren't exactly "legal." Should she not be a citizen?

I think they are speaking about the "bring us your poor huddled masses, bla bla bla, We can only keep excepting the immigrants as long as we had the resources to sustain them as of right now we need to shut the door and take inventory of what is going on here and now, and care for our own people . Illegal Aliens mean that they don't exist in the country legally, so if they don't exist legally how are they going to have Rights.. We don't have any responsibilities with these people, other than make sure that they are send back to their home safely. Good luck..
