You are in a very tricky situation because these circumstances are commonly used to commit benefit fraud. It means the Council will be all over you and your claim.
The fraud they are trying to stop works like this: you lease your flat from a friend, partner or relative and pay them "rent" each month, which (unbeknown to the Council) they give back to you. Meanwhile, you claim housing benefit to cover the cost of the "rent" and receive (illegal) monthly benefit payments from the Council.
The Council will want to be sure that you actually have to pay rent to this person, and you will have to prove that, if you didn't pay any rent, you would not be allowed to live there. You will also have to prove that you are not a beneficiary of the rent payment, either directly or indirectly.
Speak to the Council early on to make sure you get it right; if they suspect you have been claiming housing benefit illegally they will absolutely through the book at you!

I think they look at whether your ex or you is gaining financially from the benefit. For example, will you gain from the payment of the housing benefit because it is going towards a mortgage that you are paying together with your ex-partner. They will also consider why you are having to pay rent to the man who is the father of your child in order to keep a roof over his child's head. They will also consider whether the rent he is charging you is a fair rent for your area.
Check on the direct gov website to see if you are eligible.

Yes they do not require personal information like who is the father to your child
Housing benefit can be back dated as well if you claim as soon as u can

contact your local council for a form then once you have filled it in send it back to them and they deal with the rest make sure you put your ex partners details in the section where it asks about the landlord

Either ring up a benefit enquiry line or go down to you local council and they will be able to tell you if you are eligible or not.

the best site for information on this is www.entitledto.co.uk its very good although I'm sure if its family they will not pay it but as it is your ex they may do. they will probably come to see you and ask lots of things to make sure your not together any more. good luck
